1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the website finhavenarc.com (the “Website”) and our FinHavenArc Screener (the “Screener”), a free, open-source program that you download and install yourself and that delivers alerts through your own Telegram account. A Telegram account is required to use the Screener, and an English-language description is available on the Screener page. The Website and the Screener are provided by Jozsef Huszar, based in Hungary, European Union (“we,” “us,” or “our”).

By accessing or using the Website or the Screener, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Financial Disclaimer. If you download or use the Screener, the Screener License also applies to you. If you do not agree, please stop using the Website and the Screener. You also agree to comply with all laws and regulations that apply to your use of them.

2. Eligibility

You must be at least 18 years old to use the Website and the Screener. See also Section 9 of our Privacy Policy.

3. No Financial Advice

Everything we publish or provide, including the Screener and the alerts it produces, is general and impersonal and is provided for informational and educational purposes only. It is not personalized financial, investment, legal, or tax advice, and it is not an offer or recommendation to buy, sell, or hold any security or financial product. Please read our Financial Disclaimer, which forms part of these Terms. You are solely responsible for your own decisions.

4. Intellectual Property

The content published on the Website, including text, articles, graphics, logos, images, and data compilations, is owned by or licensed to us and is protected by copyright and other intellectual property laws. Unauthorized use may violate those laws. The source code of the Screener is made available under the Screener License, which is also stated in the Screener’s repository and on the Screener page. 5. Permitted Use and Restrictions

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use. Your rights to the Screener, including to use, copy, modify, and distribute it, are governed by the Screener License. If these Terms conflict with the Software License regarding the Screener’s source code, the Software License applies to the code. For the Website, you agree not to:

  • use the Website or the Screener for any unlawful purpose;
  • encourage or assist others in unlawful acts;
  • upload or transmit viruses, malware, or any other malicious code;
  • use any bot, scraper, or data mining tool to access or extract data from the Website, except for ordinary search engine indexing;
  • copy, modify, republish, resell, or distribute the Website’s content, except as permitted on our Copyright page or with our prior written consent;
  • interfere with the security or normal operation of the Website or of any service we use to provide it.

You install and run the Screener at your own risk, on your own devices, with your own Telegram account and data sources. You are responsible for your own device, for backing up your data, and for keeping your credentials (such as Telegram bot tokens and data-provider API keys) secure; we cannot see or recover them, as explained in Section 6 of our Privacy Policy. You are also responsible for complying with the terms of Telegram and of any data provider you use with the Screener. Please download the Screener only from the Website or from the repository linked on it.

6. Technical Help

We may help you with installing and using the Screener on a voluntary basis, free of charge. We are under no obligation to provide help, updates, or fixes, and we do not guarantee any response time or result. Help we provide is not financial advice (see our Financial Disclaimer). Please do not send us passwords, API keys, bot tokens, or account credentials when asking for help.

7. Third-Party Links and Services

The Website and the Screener may link to or rely on third-party websites, platforms, and data providers, including Telegram. We do not control them and are not responsible for their content, availability, accuracy, privacy practices, or terms. Your use of any third-party service, including your Telegram account, is at your own risk and governed by that provider’s own terms and privacy policy.

8. Disclaimer of Warranties

The Website, the Screener, and all content, data, and alerts are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, timeliness, completeness, availability, or fitness for a particular purpose. We do not guarantee that the Website or the Screener will be uninterrupted, error-free, or free of harmful components. The Screener License contains additional warranty terms for the Screener’s source code.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any direct, indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Website, the Screener, or any content, data, or alerts, as further described in our Financial Disclaimer. Nothing in this section affects any mandatory rights you may have as a consumer under applicable law.

10. Indemnification

To the extent permitted by applicable law, and except where this would be unenforceable against you as a consumer under mandatory law, you agree to indemnify and hold us harmless from third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your unlawful use of the Website or the Screener or your breach of Section 5.

11. Termination

We may suspend or restrict your access to the Website at any time, with or without notice, including if you breach these Terms. You may stop using the Website and the Screener at any time. Termination of your access to the Website does not affect your rights under the Screener License. Sections that by their nature should survive termination, including Sections 3, 4, 8, 9, 10, and 12, continue to apply.

12. Governing Law

These Terms are governed by the laws of Hungary, without regard to conflict-of-law principles. Any dispute will be handled by the competent courts of Budapest, Hungary, to the extent permitted by applicable law. Nothing in this section limits any mandatory consumer protection rights you may have under the laws of your place of residence.

13. General Provisions

These Terms, together with the Privacy Policy, the Financial Disclaimer, and the Screener License, are the entire agreement between you and us regarding the Website and the Screener. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.

14. Changes to These Terms

We may update these Terms from time to time. We will post the new version on this page with a new “Last updated” date. Your continued use of the Website or the Screener after changes are posted means you accept the updated Terms.
